ABSTRACT
to the dissertation work of the doctoral student of the Academy of Public
Administration under the President of the Republic of Kazakhstan Nauryzbek
Madina Dulatkyzy on the topic “Conflict of interest in the public service:
prevention mechanisms in the Republic of Kazakhstan” submitted for the degree
of Doctor in profile of the educational program “8D04113 – Public
Administration”
The relevance of the research. According to the World Bank, the amount of
bribes in the world is 1 trillion dollars a year. In turn, the amount of stolen funds is
estimated at $2.6 trillion a year.
In Kazakhstan, corruption is also being fought mercilessly and purposefully.
According to the Anti-Corruption Agency of the Republic of Kazakhstan, the total
damage in 2021 amounted to 23.8 billion tenge, 892 people were convicted of
corruption offenses.
The concept of conflict of interest is usually discussed both in the context of anti-
corruption policy and as a separate public policy. It should be noted that at the heart of
an effective public service system lies a moral responsibility for the public interest.
Thus, the personal interests of public servants must be subordinated to the public
interest.
The United Nations calls on all Member States to take steps to prevent conflicts
of interest. In Kazakhstan, conflicts of interest are officially recognized as an urgent
problem at the state level.
Thus, the Concept of the Anti-Corruption Policy of the Republic of Kazakhstan
for 2022-2026, approved by Decree of the President of the Republic of Kazakhstan
dated February 2, 2022 No. 802, defines the prevention and settlement of conflicts of
interest as a trend and prospect for the development of anti-corruption policy.
From the practical experience of Kazakhstan, it can be said that conflicts of
interest in the public service have not yet been fully studied. To date, there are not
enough analytical materials to provide mechanisms for preventing and resolving
conflicts of interest in the public service. As a result, the problem of resolving conflicts
of interest in the public service of the Republic of Kazakhstan is of great importance,
requiring in-depth analysis, research and search for effective mechanisms for
prevention and regulation. At the same time, the relevance of the study is confirmed
by the fact that the regulatory framework has not yet been prepared, and the scientific
reference apparatus is in doubt.
The objective need to analyze the current state of the conflict of interest and
identify current problems, study the legal framework of Kazakhstan and international
best practices, develop an effective mechanisms for preventing and resolving conflicts
of interest in the public service, in the aggregate, was the basis for choosing a topic,
goals and objectives.
The level of research on the topic. A number of foreign studies are devoted to
the settlement of conflicts of interest in the public service.
